Terms of Service

1. Definitions

"Company", "we", "us", "our" means Viking Online Services Gromosław Czerski trading as Grom Growth.

"Customer", "you" means the business entity purchasing our digital infrastructure and SaaS subscriptions.

"Services" means all digital infrastructure, custom web development, ongoing software access, CRM, hosting, and related services provided by Grom Growth.

"Platform" means any software systems used to deliver the Services, including our CRM dashboard, Stripe, Inc. (our payment processor), and related infrastructure.

2. Scope of Services

We build custom websites for a one-time fee and provide ongoing hosting and lead management CRM on a recurring monthly basis. Complete scope depends on your plan. The Services are strictly business-to-business (B2B). You confirm that you are acting in the course of business. We do not guarantee specific business results or financial returns. Our services are strictly providing the website build, hosting, and CRM access as agreed.

3. Account Access

You are responsible for maintaining the confidentiality of your login credentials and all activity occurring under your account. You must ensure that any users you authorize comply with these Terms.

4. Payments, Billing, and Subscription Commitments

• Payments are securely processed via our third-party payment Sub-Processor, Stripe, Inc.
• The one-time website build fee ($500) is payable before work begins.
• Ongoing hosting and CRM access is billed automatically on a 30-day recurring or annual cycle, as selected during checkout.
• 12-Month Commitment: If you have joined a subscription, you must remain in the subscription for a full calendar year (12 calendar months).
• Early Termination Fee: If you decide to cancel before the 12-month period is up, you must pay a $1,000 early termination fee.
• Cancellation Notice: You must provide at least 30 days notice before cancelling, otherwise you will be charged for the next period.
• Chargeback Waiver: You explicitly waive your right to credit card or bank chargebacks or payment disputes of any kind.
• As our hosting services involve immediate resource allocation, no prorated refunds are provided for mid-cycle cancellations.
• Failure to pay will result in immediate suspension of website hosting and CRM access.

5. Messaging and Compliance

You acknowledge and agree:

• The Services may send SMS, email, voice or automated messages on your behalf.
• You are solely responsible for obtaining all required customer consents and opt-ins.
• Compliance with all applicable laws (GDPR, telecom regulations, marketing laws, etc.).
• We accept no liability for regulatory fines, carrier blocking, or delivery failures.

You indemnify us against all claims arising from your messaging usage.

6. Data Storage and Processing

Customer and end-user data is primarily stored in our CRM dashboard and Stripe, Inc. We act as a data processor where applicable. You remain the data controller for your customers' personal data in compliance with GDPR extraterritoriality laws.

7. No Guarantees

We build websites for a one-time fee and provide hosting and CRM access on a monthly basis. We make no guarantees regarding outcomes such as "lead volume," "revenue growth," or "explosive scaling." Our services are straightforward: we build your website, host it, and provide access to the CRM.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the fees paid by you in the last one (1) month prior to the claim. We are not liable for indirect, incidental, or consequential damages.

12. Governing Law

These Terms are governed by the laws of Poland. All disputes shall be resolved by binding arbitration in Poland, unless mandatory law requires otherwise.
